Terms of Service / End User License Agreement

Starherald — Open Beta

Last updated: 19 October 2026

Effective date: 19 October 2026

IMPORTANT NOTICE — PLEASE READ FIRST

Starherald is a live online multiplayer game that is currently in open beta.

By playing you acknowledge and accept that:

• The Game is currently free and contains no paid content and no real-money purchases. If we add paid content in the future, we will update these Terms and ask for your agreement again before it takes effect.

• We do not currently plan to wipe player progress when the open beta becomes the full release. However, in the event of a serious defect, data corruption, large-scale cheating, or another technical incident affecting fairness, we may roll back or correct the affected data. We will give advance notice where feasible.

• The Game is still in development and may be unavailable, unstable, or defective at any time; features, balance, and content may be changed or removed.

• The Game is not licensed in, and is not operated or offered in, mainland China (see Section 2).

If you do not accept these conditions, do not play.

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Flying Bird and Sea Network Technology Pte. Ltd., a company incorporated in Singapore (Unique Entity Number (UEN): 202646877D) with its registered address at 1 Pasir Panjang Road, #30-01, Labrador Tower, Singapore 118479 ("we," "us," "our"), governing your use of Starherald (the "Game").

By downloading, installing, accessing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game. On your first login you will be asked to confirm in the Game that you have read and accept these Terms; we record the version you accepted.

2. Eligibility and Regions

You may use the Game only if:

• You are at least 13 years of age. Where the law of your region sets a higher age of digital consent (for example 14 to 16 in some EEA countries, or 14 in South Korea), that higher age applies. If you are under the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

• You have a valid Steam account in good standing.

• The Game has not been licensed for publication or operation in mainland China and is not operated or offered there. If you are located there and nevertheless choose to use the Game, you are responsible for confirming and complying with your local law.

• You are not barred from using the Game under any applicable law, and you are not located in a country subject to relevant trade sanctions.

We do not knowingly permit users below the applicable age to use the Game. If we learn that a user is under age, we will terminate access and delete associated data.

3. Steam Account Required

The Game uses Steam for authentication, and you need a Steam account to play. In addition, we issue invitation codes to selected testers; a tester with an invitation code may register a test account with an email address and password. Registration is not possible without a code. Test accounts are equally bound by these Terms and the Privacy Policy.

Your use of Steam is governed separately by the Steam Subscriber Agreement and Valve's own policies. Nothing in these Terms modifies your agreement with Valve. We are not responsible for Steam's availability, for actions Valve takes on your Steam account, or for any consequence of losing access to your Steam account.

If you lose access to your Steam account, you will lose access to the Game and to any associated game data. We cannot move progress to a different Steam account.

4. Licence

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and play the Game for your own private, non-commercial entertainment.

This is a licence, not a sale. We and our licensors retain all right, title, and interest in the Game.

You may not:

• Copy, distribute, sell, rent, lease, or sublicense the Game

• Reverse engineer, decompile, or disassemble the Game, except to the extent this restriction is prohibited by applicable law

• Modify the Game, or create or use cheats, trainers, bots, automation tools, or unauthorised third-party software that interacts with the Game

• Access or attempt to access the Game's servers, APIs, or network traffic other than through the official client

• Use the Game to develop a competing product

• Remove or alter any proprietary notices

What you may do

• Streaming and videos. You may record, stream, and publish gameplay of the Game, including with advertising revenue, provided you do not imply that we endorse your content and do not use Game assets to make products unrelated to the Game.

• Multiple accounts. Logging in to several accounts you own at the same time on the same device is not itself prohibited, but it must not be used to evade enforcement, farm resources, manipulate the market, or otherwise breach Section 5.

Anti-cheat

All gameplay decisions are made on our servers. We do not scan other processes, files, or hardware information on your device. We detect cheating from the gameplay data our servers receive.

5. Code of Conduct

The Game includes chat, in-game mail, character and corporation naming, and other features that let you communicate with other players. You are solely responsible for everything you transmit.

Prohibited conduct

You must not use the Game to:

• Harass, threaten, stalk, bully, or intimidate any person

• Post or transmit content that is hateful, or that attacks or demeans a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or age

• Post or transmit sexual content involving minors, or any content that sexualises minors, in any form. This is absolutely prohibited and will be reported to the relevant authorities.

• Attempt to contact, solicit, or groom a minor for any inappropriate purpose

• Post or transmit content that is obscene, violent, or otherwise unlawful

• Impersonate any person or entity, including our staff

• Post personal information about another person without their consent ("doxxing")

• Post or transmit spam, advertising, or solicitations

• Post content that infringes any third party's intellectual property or other rights

• Exploit bugs, glitches, or errors for advantage, or fail to report a serious exploit when you discover one

• Engage in the sale, purchase, or exchange of accounts or in-game items for real-world value

• Interfere with the operation of the Game or with other players' use of it

• Do anything unlawful under the laws that apply to you

Naming

Character names, corporation names, and any other names you choose are subject to the same standards. We may change or remove any name at our discretion.

6. User Content

"User Content" means anything you transmit through the Game, including chat messages, in-game mail, names, and any other material you create or submit.

Your responsibility

You are solely responsible for your User Content. You represent that you have all rights necessary to submit it and that it does not violate these Terms or any law.

Licence to us

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and transmit your User Content solely for the purpose of operating, moderating, and improving the Game. This licence ends when your User Content is deleted, except to the extent we must retain it to comply with law or to resolve a dispute.

Automated screening; no human pre-screening

Chat and in-game mail pass through automated content screening before publication (see the Privacy Policy). Content that fails screening is blocked and the reason is shown only to you. Beyond that, we do not review User Content by hand before it is transmitted. We are not responsible for User Content created by others. Any views expressed by other players are theirs, not ours.

Reporting

If you see User Content or behaviour that violates these Terms, use the in-game report function (you can report a specific message or a player) or email clientservice@starheraldgame.com. We will review reports, take the action we consider appropriate, and where feasible tell the reporter the outcome.

Intellectual property complaints

If you believe User Content in the Game infringes your copyright or other intellectual property rights, email clientservice@starheraldgame.com with: a description and evidence of your rights; the location of the allegedly infringing content (character name, corporation name, or message time and channel); your contact details; and a statement that you believe in good faith the use is not authorised.

7. Moderation and Enforcement

We may, with or without notice:

• Remove or edit any User Content

• Warn, mute, restrict features of, suspend, or permanently ban any account

• Refuse access to the Game to any person

We may do this for a violation of these Terms, for conduct we consider harmful to other players or to the Game, or where required by law. Enforcement will be proportionate to the seriousness of the conduct.

Statement of reasons and appeals

For mutes, suspensions, and bans we will tell you, in the Game or through a channel linked to your Steam account, the scope and duration (if any) of the action and a summary of the reasons, except where the law prohibits this or where notice would compromise an investigation.

If you believe we have acted in error, you may appeal within 6 months of the action through the in-game appeal function or by emailing clientservice@starheraldgame.com. Appeals are handled by a person, and we will reply within a reasonable time. We will consider appeals in good faith but are not obliged to reverse any decision.

No compensation will be provided for any enforcement action. The Game is currently free with no purchases, so no monetary loss arises from enforcement.

8. Virtual Items and Game Data

All characters, items, currency, progress, and other in-game data:

• Are licensed, not owned. You have no property right in them.

• Have no monetary value and are not redeemable for money or anything of value

• May be modified, reduced, rolled back, or removed by us for balance, bug fixing, anti-cheat, or technical reasons. For wide-ranging changes we will make reasonable efforts to give advance notice in the Game or on the Steam store page.

You may not sell, trade, or transfer game data outside the Game.

9. Feedback

We welcome your feedback. If you send us suggestions, ideas, bug reports, or other feedback about the Game ("Feedback"), you agree that:

• We may use it freely, for any purpose, without restriction, attribution, or compensation

• You waive any claim to compensation or ownership in respect of anything we build that resembles your Feedback

• You will not send us Feedback that is confidential or that you do not have the right to share

10. Availability and Changes

We may at any time:

• Change, patch, or update the Game

• Take servers offline temporarily for maintenance or for any other reason

• Change, suspend, or discontinue any feature

If we decide to permanently shut down the Game, we will announce it in the Game and on the Steam store page at least 30 days in advance, except where advance notice is impossible because of legal requirements, force majeure, or third parties outside our control (including Steam).

11. Disclaimer of Warranties

The Game is provided "as is" and "as available," with all faults, and without warranty of any kind.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Game will be uninterrupted, secure, error-free, or free of harmful components.

You use the Game at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply to the maximum extent permitted, and nothing in these Terms limits any rights you have under mandatory consumer protection law that cannot be waived.

12. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of goodwill, or business interruption, arising from or relating to the Game

• We are not liable for the conduct or content of other users

• Our total aggregate liability to you for all claims arising from or relating to the Game shall not exceed SGD 100. You acknowledge that the Game is provided free of charge and that this limit is reasonable in that context.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your User Content, your use of the Game, or your breach of these Terms or of any law or third-party right. This Section does not apply to the extent that, as a consumer, you cannot be required to give such an indemnity under your local law.

14. Termination and Accounts

You may stop using the Game at any time and may request deletion of your account and data as described in our Privacy Policy.

We may terminate or suspend your access for a breach of these Terms. Where we end the service for other reasons, we will give notice under Section 10.

We may delete or anonymise (remove the identifiers linking it to you) an account that has not logged in for 36 consecutive months, after giving notice through a channel linked to your Steam account. Progress cannot be restored after deletion.

Sections that by their nature should survive termination will survive, including Sections 6 (licence to us), 9, 11, 12, 13, and 16.

15. Changes to These Terms

We may update these Terms. If we make a material change (including adding any paid content), we will notify you in the Game or on the Steam store page before the change takes effect and ask you to confirm again at your next login. If you do not accept the updated Terms, stop using the Game; you may request deletion of your data under the Privacy Policy.

16. Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

Any dispute shall be subject to the exclusive jurisdiction of the courts of Singapore.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your place of residence, or grants you protections that cannot be contractually excluded, nothing in this section removes those rights. EU consumers may also use the European Commission's online dispute resolution platform.

17. General

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Game.

• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.

• No waiver. Our failure to enforce any provision is not a waiver of it.

• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or transfer of assets, and will notify you if we do.

• Language. These Terms are drafted in English. Any translation is for convenience only; the English version controls.
